After a suspension, write-up, demotion, or discharge, many employees want to see what is in the personnel file and want to know whether an employer is legally obligated to provide a copy of a personnel file or any information in it. In general, a Georgia employer is not legally required to give you any information from your personnel file. While some states, such as California and Illinois, have passed state laws that require an employer to produce a personnel file in response to a request from an employee, Georgia has not.
Accordingly, unless a Georgia employee has a contractual right to inspect their personnel file, a Georgia employer is not legally required to provide a personnel file to a current or former employee.
